What a bummer for you guys.

Here's hoping the next surprise in your lives is a pleasant one.Petunia 100https://www.blogger.com/profile/11419094642410711334noreply@blogger.comtag:blogger.com,1999:blog-3851322133816062332.post-89413477560134224262009-02-17T21:27:00.000-08:002009-02-17T21:27:00.000-08:00I would think, just possibly, that if the DoE had ...I would think, just possibly, that if the DoE had sent you any paperwork stating that you only owed "X" (I am assuming there were penalties etc. in those two loans you rehabbed) you could argue that when you asked them how much he owed and they sent you documentation you assumed that all debts were tied into it, and you would have had no way to differentiate the interest and penalties from the base amount owed.

While I agree that it is the borrower's responsibility to track how much they owe, we know that promissory notes, credit card statements are designed to be misleading, but as a lender it is my responsibility to both keep track of what is owed me, and to inform people that they owe a debt before I send it to collections, especially with student loans they inform you when your grace period is over, etc. and you (assumption again) received no notice.

Also, when it was tied to his ssn it should have immediately showed up on his account back in October. I would still try to negotiate as they know you were paying on the ssn as recently as October and there was no reason for this to go to collections with interest and penalties without contacting you. If they tell you all of your loans are in good standing and report that to you, you have no reason to doubt that.

You're right you might not get anywhere, but any other creditor is required to notify you if they are going to send you to collections, and the government should too. I would try to get it to the amount that they initially assigned to the other guy because technically, that is all you could know that you owed in the first place.

Good luck, and I'm sorry about life's cruel joke for you guys.

Mrs. Moderntightwad
(formerly a.b.)Mrs. Modern Tightwadhttps://www.blogger.com/profile/03594519536137591554noreply@blogger.comtag:blogger.com,1999:blog-3851322133816062332.post-64576212290518647022009-02-17T21:07:00.000-08:002009-02-17T21:07:00.000-08:00Oh, I feel for you!I just found out recently that ...Oh, I feel for you!

I just found out recently that I've owed $600 to a local hospital for about 4 years from when I had my wisdom teeth out. I only found out after going to the same department I went to 4 years ago. Other doctors' offices in that hospital network never said a thing, I never even got a bill, and it's not like I moved or something. It's ridiculous!

Oh, and figuring out why I supposedly owe this money has been crazy. The office said that the insurance paid it, then asked for it back because it was for a "preexisting condition" -- which a. no it wasn't and b. shouldn't matter because those are covered. Then the insurance said that it was because the hospital had an out of network doc work on me while I was under anesthesia even though I started with an in-network doc. Of course, it's not like they asked me about the switch!

So... we have $600 now set aside to pay this doc if we can't fight it or forget about it.

And we're in the middle of a refi so it's not like we want to have this or anything else on our credit report! They mentioned that we owe someone money after they checked our report, but we haven't figured out yet if that's another someone or the hospital bill. At least it doesn't seem to be affecting our score very much since we always pay bills on time -- at least, the ones we actually know about.Meghttps://www.blogger.com/profile/10618960384664890953noreply@blogger.com
